The arbitration shall take place in San Jose, California before a single neutral arbitrator from the panel of AAA. The Rules of Evidence of the State of California, including the rules relating to hearsay, will apply to the arbitration. The arbitrator shall issue a written decision and award including the essential findings and conclusions on which the award is based.
